TELEVISION NEWS ACCESS RULES APPLICABLE TO THE 2007 SOUTH PACIFIC GAMES
When exclusive television rights to broadcast the 2007 South Pacific Games (the "2007 SPG") are granted by Octagon Australia ("OA") to an organization for a particular territory ("Rights Holder"), no other organization may broadcast sound or images of any 2007 SPG events, including sporting action, Opening, Closing and medal ceremonies, or other activities (including training and interviews) which occur at 2007 SPG venues ("SPG Material") in that territory, beyond that which is allowable under these News Access Rules.
"SPG venues" shall include all venues which require a 2007 SPG accreditation card or ticket to gain entry, including the 2007 SPG village, the competition sites, the practice venues.
The site(s) at which medal ceremonies take place shall also be considered as a 2007 SPG venue(s) during the time when the medal ceremonies actually take place.
For the sake of clarity, these News Access Rules apply only to television and radio broadcasting. 2007 SPG Material may not be transmitted or communicated via the Internet or any other interactive media or electronic medium without the express prior written approval of OA.
These News Access Rules are subject to applicable national laws and regulations. In appropriate cases, OA may agree with Rights Holders in their particular territories to issue supplemental news access rules for such territories.
In the case of an all-news network, it may utilize 2007 SPG Material during multiple news broadcasts, as long as the combined time of 2007 SPG Material shown does not exceed a total of six minutes per day and does not exceed a total of two minutes in any one Programme.
6. Non-Rights Holders may broadcast 2007 SPG Material in accordance with the other conditions contained in these News Access Rules, as follows:
(i) upon the conclusion of the day (i.e. 24:00 hours) in which the 2007 SPG event has been broadcast by the Rights Holder in the specific territory provided that there shall be an interval of at least fifteen (15) hours between the conclusion of the 2007 SPG event and the news broadcast of such 2007 SPG event by the non-Rights Holder;
(ii) upon the conclusion of the day (i.e. 24:00 hours) immediately following the day in which the 2007 SPG event concludes, if the 2007 SPG event was not broadcast by the Rights Holder in the specific territory on the day which the 2007 SPG event concluded;
or
(iii) at such time as may be agreed by the Rights Holder for its particular territory and that particular 2007 SPG event. Broadcasts of 2007 SPG Material shall terminate not later than forty-eight (48) hours after the earliest time at which broadcasts of such 2007 SPG Material by the non-Rights Holder may begin.
7. Non-Rights Holders, provided they are holders of ENR accreditation, will have access, with equipment, to all official press conferences held in the Main Press Centre ("MPC") as well as access, without equipment, to other 2007 SPG venues. However, notwithstanding the foregoing, holders of ENR accreditation shall not have access to 2007 SPG venues for 2007 SPG events listed as ticketed high-demand sessions. ENR access shall not entitle a non-Rights Holders to originate or broadcast any programming or feed from the 2007 SPG venues, including the MPC. However, notwithstanding the other provisions of these News Access Rules, the non-Rights Holders may broadcast all or portions of press conferences held in the MPC with a delay of at least thirty minutes from the conclusion of the press conference.
8. Non-Rights Holders may broadcast via the Internet all or portions of press conferences that take place in the MPC, without any territorial restrictions, provided that there is a delay of at least thirty minutes from the conclusion of the press conference. Rights Holders may broadcast via the Internet all or portions of such press conferences, without any territorial or time restrictions.
9. The South Pacific Games Organising Committee (“SPGOC”) of 2007, in collaboration with OA, will establish the 2007 SPG News Agency ("SPGNA") which may enter into agreements with non-Rights Holders or news agencies with respect to the supply of 2007 SPG Material copyrighted in the name of the SPG. 2007 SPG Material obtained through the SPGNA shall not be used except as expressly authorized for in these News Access Rules.
10. 2007 SPG Material shall not be provided by the SPGNA to non-Rights Holders or news agencies unless they provide a prior written guarantee, in form and substance satisfactory to the SPG, that they will fully comply with all terms and conditions of these News Access Rules.
11. Non-Rights Holders and news agencies shall respect the following provisions:
(i) they shall not make available or provide 2007 SPG Material to any third party without the express prior written consent of the OA;
(ii) they shall ensure that no advertising, promotion, publicity or other message appears at the same time (be it superimposed or on a split screen or otherwise ) as 2007 SPG Material and/or at the same time as any other coverage of the 2007 SPG Games which contains any 2007 SPG imagery or 2007 SPG marks; and
iii) they shall ensure that no advertising or other message is placed before, during or after the broadcast of 2007 SPG Material, in such a manner as to imply an association or connection between any third party, or third party's product or service, and 2007 SPG
Material or the 2007 SPG Games.
12. Each broadcast of 2007 SPG Material shall give an on-screen credit to the Rights Holder in the particular territory.
13. The accreditation of any person(s) accredited at the 2007 SPG Games may be withdrawn without notice, at the discretion of OA, for purposes of ensuring compliance with these News Access Rules.
14. These News Access Rules shall come into effect when a 2007 SPG accreditation card or ticket is required to obtain access into any of the 2007 SPG venues. From the time that these News Access Rules come into effect until 48 hours following the conclusion of the 2007 SPG Games, their operation shall be effected by the Executive Producer of OA in consultation with the SPGOC. OA shall be the final authority with respect to the interpretation and implementation of these News Access Rules.
